(1)Warning and release. The least severe sanction is applied when the patrol officer decides merely to question and release the youth. Commonly, this occurs when a juvenile is caught committing a minor offense.
(2)Station adjustment. The juvenile can be taken to the station, where the juvenile will have his or her contact recorded, will be given an official reprimand, and then will be released to the parents. In a station adjustment, the first thing the department does when the juvenile is brought to the station is to contact the parents.
(3)Referral to a diversion agency. The juvenile can be released and referred to a diversion agency. In some jurisdictions, the police operate their own diversion program; more typically, juveniles are referred to agencies such as Big Brothers Big Sisters, a runaway center, or a mental health agency.
(4)Citation and referral to juvenile court. The police officer can issue a citation and refer the youth to the juvenile court. Law enforcement agencies refer more than four-fifths of the delinquency cases handled by juvenile courts.
(5)Detention. The police officer can issue a citation, refer the youth to the juvenile court, and take him or her to a detention center. An intake worker at the detention center then decides whether the juvenile should be returned to the parents or left at the detention center. A juvenile is left in detention when he or she is thought to be dangerous to self or others in the community or has no care in the home. Taking youths out of their homes and placing them in detention facilities clearly must be a last resort.
After reading the following scenarios, please thoroughly develop your responses to the choice of action you as a police officer would make when dealing with the youth in these scenarios. Please be sure to support your selected decision.
Scenario #1: Paul is a 14-year old male youth who was caught drinking beer in the abandoned parking lot behind a 7-11. Paul was also found to be in possession of cigarettes. Paul was supposed to be in school and lied to his parents about supposedly going to school that day. Paul has a history of truancy, curfew violations, and substance abuse.
Scenario #2: Esmeralda is a 16-year old female youth who presents with a history of verbally assaulting her mother. On the day in question, she asked her mother to borrow the family car, the request was denied. Esmeralda became enraged and punched her mother in the face. She also verbally assaulted her mother and threatened her with additional bodily harm. Esmeralda has never physically lashed out her mother prior to this occasion but the tension and the animosity has definitely been escalating. Upon being punched in the face, Esmerelda's mother called 911 to report the incident.
Scenario #3: Joseph is an 17-year old male who was caught at his high school making threats against his fellow students indicating that he was going to "shoot everybody someday". Joseph has a history of being bullied and teased and is painfully shy and socially awkward around his peers. Joseph has been in therapy for the past three years because of depression and anxiety. Joseph also has a history of being physically assaultive to his two younger siblings in addition to the family cat. Joseph has also set three fires to date, one in his family garage and two on school property. The principal contacted law enforcement after Joseph made violent threats again the school and the other students.
Scenario #4Karen was part of the Mean girls club at Stadium High School. Karen and her friends even got tattoos to show their support of their crew, 'The MG Crew'. Karen was angry at a Senior (Brittney) who was taking her spot in the first string of the Varsity Basketball Team position. Karen told her crew she was going to cut Brittney achilles' tendon when she was taking a show and she whipped out a switch blade.
