In Pennsylvania, Involuntary Manslaughter is defined as follows:

"A person is guilty of involuntary manslaughter when as a direct result of the doing of an unlawful act in a reckless or grossly negligent manner, or the doing of a lawful act in a reckless or grossly negligent manner, he causes the death of another person." 18 Pa.C.S.A. 2504 (a) (1995).

The mens rea required for involuntary manslaughter is Recklessness or gross negligence. The actus reus is committing any act (whether they be lawful or unlawful) that causes the death of another.

An example of involuntary manslaughter is Sally picks up a gun that she thinks is not loaded and shoots it into the street, killing someone who is driving by in a car. The mens rea is met in that it is grossly negligent or reckless to shoot a gun into a street with traffic, even when you think the gun is not loaded. Sally should have checked to see if the gun was loaded and shouldn't have shot it into the street in any event. Doing so is grossly negligent and reckless. The actus reus are her acts of shooting a gun into a street with traffic and causing the death of the motorist
