After the D.E.A. agents squeezed Dan Slater's nose to make him gasp for air, he asked for an asthma inhaler to be retrieved out of his backpack. The agents told him he would be fine by settling down and cooperating. Slater continued gasping for air, pleading for his inhaler, until losing consciousness. Paramedics were called and transported Slater to the nearest hospital, where he recovered after one week in ICU. Defense: Slater's arrest was an unreasonable seizure under the Fourth Amendment. Prosecution: Slater's arrest was a reasonable seizure under the Fourth Amendment.
