  1. Defining the Term of the Tenancy: Agreement term shall commence on __________________, and shall continue from month to month. This rental agreement may be terminated at any time by either party by giving written notice 30 days in advance.

  9. This is a no smoking dwelling. Tenants or tenants guests shall not smoke in house or in areas that will disturb neighbors. If smoking occurs in the house, tenants are responsible for all charges to rid the unit of any smoke-related residue, typically $___________.
  10. Unit is subject to an annual inspection. Upon not less than _____ hours advance notice, Tenants shall make the premises available during normal business hours to Landlord or his authorized agent or representative, for the purpose of entering (a) to make necessary repairs, decorations, alterations or improvements or to supply necessary services, and (b) to show the premises to prospective or actual mortgagees, workmen or contractors. This clause includes but is not limited to roommates, paying or not. Any additional occupants, with discretion and approval of landlord, will increase monthly rent.
  12. If Tenants shall fail to pay rent when due, or perform any term hereof, after not less than three (3) days written notice of such default given in the manner required by law, Landlord, at their option may terminate all rights of Tenants hereunder, unless Landlord, within said time, shall cure such default.
  13. If Tenants abandon or vacate the premises, Landlord may at their option terminate this agreement, and regain possession in the manner prescribed by law. If Tenants abandon or vacate the property, while in default of the payment of rent, Landlord may consider any property left on the premises to be abandoned and may dispose of same in any manner allowed by law.
  14. If any legal action or proceeding is brought by either party to enforce any part of this agreement, the prevailing party shall recover in addition to all other relief, reasonable attorneys fees and costs.
  15. Time is of the essence. The waiver by Landlord or Tenants of any breach shall not be construed to be a continuing waiver of any subsequent breach.
  16. Notice upon Tenants shall be served as provided by law. Notice upon Landlord may be served by calling Landlord to arrange service. Phone number: 562-555-5555.
  17. Within ten (10) days after written notice, Tenants agree to execute and deliver a certificate as submitted by Landlord acknowledging that this agreement is unmodified and in full force and effect or in full force and effect as modified and stating the modifications. Failure to comply shall be deemed as Tenants acknowledgement that the certificate as submitted by Landlord is true and correct and may be relied upon by any lender or purchaser.
