You need to review the following cases to see if any show the judge in the favor of the person in the similar situation to our client. Sometimes you will not be able to find a case that shows this, and that is ok as well.
Once you have a case that you believe the lawyer should review further, please draft a memo to the lawyer in charge of the case (prepare separate memo for each case) indicating the following information:
1)the keywords you used to conduct your search.
2)the name of the case and the citation.
3)a brief synopsis of the case (what was the basis of the case and what was the outcome).
They are asking you to conduct legal research by using the website www.canlii.org. Legal research is done by locating cases with similar synopsis' as the case you are working on, to determine how other judges have decided cases.
CASE 1
Travis Dorn is representing a group of people who are filing a class action suit against a local restaurant. The group of 27 were patrons at the establishment last June 28. Shortly after their visit (at various times throughout the day) they began getting severely ill and were taken to the emergency room where they were all diagnosed with E. Coli.
CASE 2
Daniel Murphy Sr. represents a local hockey association that is being sued by a family. The family states that while attending one of the hockey games, their 6-year-old son was hit with a puck that was shot over the side. Mr. Murphy has asked that you look up similar cases including voluntary assumption of risk.
CASE 3
Daniel Murphy Sr.'s client, Mary Mumford, is an elderly lady who had signed a contract which she assumed had stated she would sell her property for $150,000. Mrs. Mumford was on medication at the time and admitted to the witness to her signature (who also was the purchaser's brother) that she could not see things too clearly due to the medication. The witness told her everything was as discussed with the contract and verbally read it to her, stating the purchase price was listed as $150,000, so Mary signed the document.
The next day, Mary's daughter was looking at the contract and discovered the sale price was listed as $15,000. Mrs. Mumford wants out of the contract and is seeking damages.
