Assume that Congress recently passed a law that required all U.S. citizens to obtain a special "U.S. Passport" to board an airline in the United States. This Passport requires the individual to notify the government of his/her intent to travel at least 60 days before departure. The government, if it deems the individual fit for travel, will then issue the "U.S. Passport". The passport will be good for four years and must be renewed every four years. Citizens that the government deems are not fit will not receive the passport and may not travel by air.
Write an essay that explains why this passport would violate the Due Process Clause. Your paper should contain the following:
- A constitutional explanation of why this law violates substantive due process, and/or procedural due process and why.
- The level of scrutiny to which this law should be submitted and why.
- Use at least two court cases to support your argument (you won't find any on a U.S. passport, but there are many that can be used to support your argument).
- Identify at least 2 cases discussed in this lesson that could be used to relate to this issue and explain how they relate.
