Assume you work for a consulting company that provides both legal and other practical advice to clients. Your consulting company has been hired by George G. Shady, who wants to start a publishing company, Paradin Press. He has several aspects to his proposed business model, but he is not sure if all of them are lawful, and unsure of what the potential legal and other hazards may be. He is looking for a detailed paper (or for paralegal majors, a legal memo) that identifies each specific potential legal hazard he should be concerned about, a brief description of the law in this area, a description and application of how that existing body of law applies to his situation and then your recommendation as to whether he can proceed or not. For each legal issue identified, please be sure to start a new paragraph, and for each major section of his companies proposed business plan, a new title/heading for that section, to help him quickly be able to reference the material in the paper. Your discussion and analysis will need to include an identification and discussion of any relevant statutes, case law, and/or Constitutional provisions at issue. He is looking to make much as he is legally able to, and wants to have his business operate legally, but also right up to the line of what is permitted and what is not.

His proposed business plan has the following components:

1) A website that hosts the sale of online and print copies of books. The books that are offered for sale and include books on how to "get even" with people you don't like, a book that describes the skills needed to be a "hit man", a book on how to build a home-made rocket launcher, and a book on how to destroy bridges.

2) A website that hosts a platform where users can pay him for a subscription fee, and once they login, the users then have access to an open P2P (peer to peer) sharing format, where the only content that arrives on the website is from other users, and is then shared among all the users. George G. Shady will not regulate or monitor the content, and wants to allow all content to be shared on the site, regardless of who owns it, and regardless of whether it is controversial content, or whether it is "how to" on topics like, how to destroy a bridge, or how to be a "hit man" for a living, or even "how to" material on the home-made process you can use to construct a firearm in violation of Federal law.

3) A website that hosts a platform he will call "ultimate shady", where users can upload and post their own content so they can "get back at people they don't like" and others. He expects that this site will have material that is directly disparaging towards public officials, such as the President of the United States, as well as disparaging remarks about public figures that are well known and public Hollywood actors and actresses, and even content about non-public figures, such as not-well known individual people. All of the comments for each category of people include content that specifically and directly targets them by name, with information that is not only disparaging and disrespectful, but is also untrue and defamatory. Be sure to discuss each category of person and each category of information, and the various legal standards, Constitutional principles and applicable statutes that may be at issue.
