At Miley's request, her mother sent her to a theater arts camp on Tim Buck two Lake for the summer. At Camp Wantabe, Miley and the other campers studied voice, dance and drama as well as the great outdoors. Camp Glam for budding photographers was only a half-mile down the road from Camp Wantabe and within a week Miley had become close friends with a young camper there, Tammy. One night Tammy sneaked into Miley's cabin to visit. She climbed into the bunk above Miley. They giggled for a while, but quickly fell asleep. The bunks were hung from the wall by a chain at each end in two tiers around the walls of the cabin. About 3 a.m., without warning the upper bunk containing Tammy collapsed upon Miley, breaking Miley's arm. Camp Wantabe called an ambulance service to transport Miley to the nearest hospital to have her arm set. While driving Miley to the hospital, the ambulance driver negligently lost control of his vehicle on the mountain road and overturned. Miley suffered a broken leg in the accident. Miley brings an action against Camp Wantabe for her broken leg. The court will find for:

Select one:

A. Miley, because Camp Wantabe and the ambulance service are jointly and severally liable for Miley's broken leg.

B. Miley, because Camp Wantabe did not have their own treatment facility, it is solely liable for Miley's broken leg.

C. Camp Wantabe, because the ambulance service is liable for Miley s broken leg.

D. Camp Wantabe, unless they were negligent in their selection of an ambulance service.
