ATTORNEY JIM BROWN HAS BEEN PRACTICING LAW FOR YEARS. YOU COULD CALL HIM AN "OLD-TIMER". AS A SOLO PRACTITIONER, HE RELIES ON JUNE, HIS PARALEGAL, FOR JUST ABOUT EVERYTHING. SHE DRAFTS, SIGNS AND FILES COURT DOCUMENTS, PREPARES CORRESPONDENCE, SCHEDULE CLIENTS FOR OFFICE MEETINGS AND COURT HEARINGS, KEEP JIM'S CALENDAR CURRENT, AND ANSWERS THE PHONE. AND THAT IS NOT ALL SHE DOES. WITH JIM GETTING ON IN YEARS, SHE HAS HAD TO CONSTANTLY REMIND HIM OF CLIENT APPOINTMENTS, AND COURT HEARINGS EVEN THOUGH SHE REGULARLY PUTS THEM ON HIS CALENDAR ON HIS DESK. WHEN JIM IS NOT IN THE OFFICE JUNE REGULARLY SIGNS JIM'S NAME TO DOCUMENTS SHE FILES IN COURT. JUNE ALSO SIGNS JIM'S NAME TO CHECKS DRAWN ON JIM'S PERSONAL AND CLIENT TRUST ACCOUNT. JIM TRUSTS JUNE MORE THAN HE TRUSTS HIS WIFE.

ONE DAY WHILE JIM WAS OUT OF THE OFFICE, JUNE NOTICED THAT THAT A COMPLAINT HAD TO BE FILED THAT DAY, OR THE STATUTE WOULD RUN BY THE FOLLOWING DAY. JUNE PROMPTLY PERPARED THE COMPLAINT, SIGNED JIM'S NAME TO IT, AND FILED IT. SHE WAS NOT AWARE THAT JIM HAD "BORROWED" SOME MONEY FROM THE CLIENT TRUST ACCOUNT TO PAY THE RENT ON THE OFFCE. AS A RESULT, THE CHECK THAT SHE WROTE TO FILE THE COMPLAINT BOUNCED. THE CLERK OF THE COURT DID NOT FILE THE COMPLAINT WHEN THE CHECK BOUNCED.

WHEN JUNE RETURNED FROM COURT, JIM WAS STILL OUT AND TWO POTENTIAL NEW CLIENTS WERE WAITING FOR HIM. ALTHOUGH JUNE HAD NOT YET HAD LUNCH, SHE DECIDED TO INTERVIEW THE CLIENTS. SHE JUST HATED FOR CLIENTS TO WAIT TOO LONG.

JUNE TOOK ALL THE PERSONAL INFORMATIONFROM BOTH MEN. TOLD THEM HOW MUCH IT WOULD COST THEM FOR JIM TO REPRESENT THEM IN THEIR CRIMINLA CASE, COLLECTED THE $3,000 RETAINER AND HAD THEM BOTH SIGN RETAINER AGREEMENTS WHICH SHE JUST EDITED AND PRINTED. ON HER WAY HOME, JUNE DEPOSITED THE RETAINER IN JIM'S OPERATING ACCOUNT AS SHE HAD MISTAKINGLY TAKEN THE DEPOSIT SLIP FOR THE OPERATING ACCOUNT INSTEAD OF THE ONE FOR THE CLIENT TRUST ACCOUNT.

AS SOON AS JUNE GOT HOME, SHE FELL ASLEEP, STILL IN HER OFFICE DRESS. SHE WAS EXHAUSTED. HER HUSBAND WAS CONCERNED. WHEN HE WENT TO GET HER FOR DINNER, WHICH HE HAD PREPARED, HE HAD A HARD TIME GETTING HER TO WAKE UP. OVER DINNER SHE TOLD HIM ABOUT HER DAY AND ABOUT THE TWO CLIENTS SHE HAD RETAINED. SHE EVEN TOLD HIM THEIR NAMES AND WHAT THEY HAD DONE.

THE NEXT DAY, WHEN JUNE RETURNED TO THE OFFICE, SHE DISCOVERED THAT JIM HAD CALLED THE TWO NEW CLIENTS AND DISCOVERD THAT THEY HAD BOTH BEEN INVOLVED IN THE SAME BANK ROBBERY. JIM WAS A LITTLE CONCERNED BUT HE WAS SO GRATEFU FOR ALL JUNE HAD DONE, THAT HE JUST TOLD HER NOT TO WORRY, THAT HE WOULD HANDLE IT.
