Bagan Media Sendirian Berhad (BMSB) is a well-known company that produces children animation productions in Malaysia.It planned to build a sophisticated and modern animation studio to improve their animation productions. Later, BMSB agreed to buy three acres of land in Alor Setar worth RM800,00.00 (referred as 'land A') from Puan Adnin and entered into a sale and purchase agreement on 1 February 2019. They agreed that RM400,000.00 was to be paid on the day when the sale and purchase agreement was signed and the balance would be paid after the transfer of the title of land had been completed. In March 2019, the state government released a statement that the drainage system in that area would be improved and in May 2019, the state government compulsorily acquired a few lands including land A for that purpose. Accordingly, Puan Adnin could not transfer the title of land to BMSB causing BMSB to sue Puan Adnin for the breach of contract. BMSB also claimed for the return of their money advanced to Puan Adnin but she refused to return it. What is your opinion regarding the above problem?
