Barbara is the conveyancer for Ali's purchase of a house. In the course of the conveyance, she completes a search of the Certificate of Title. Unfortunately, she fails to notice that although she has applied to the Land Titles' Office for the correct title, the Land Titles' Office has sent her a copy of a title to the neighbouring block of land. This title shows no encumbrances on the property. Because Barbara's settlement clerk is ill, she sends her inexperienced son to settlement. After settlement, Barbara cannot lodge the transfer of land as it transpires that there is a caveat on the title.
