Joyce and Jim just rented their first home together. The house needed some work, but the main thing they needed to fix was a wall that divided the living room in a way they really didn't like. They struck a deal with Karen, their landlord, that they would do the renovations themselves in exchange for a reduction in their rent. They needed some help with the renovation, so they decided to throw a housewarming/demolition party. They knew their friends would love smashing the wall. Just to be safe, though, they also hired Max, who worked for a construction company. Because there was going to be a lot going on, they decided to keep the party small. In addition to Max, they invited Robin, Dustin, and Luukas to the party. Luukas' little sister, Erika, wasn't invited. Erika was used to be excluded though, and she knew how to get around the lack of invitation. When the party was in full-swing, she would sneak in the back door to join the fun. She figured at that point, no one would care since she was already there. Demolition day rolled around and the group gathered at Joyce and Jim's new place. Everyone invited attended. After the celebrations were underway, Joyce handed out safety goggles, dust masks, and various tools to the attendees. Just as things were getting started, Luukas got thirsty, took off his safety gear, and went to the kitchen. Erika snuck in, grabbed Luukas' discarded gear, and joined the demolition. In the midst of smashing the wall, Erika's Sledgehammer hit something hard. Forgetting that she wasn't supposed to be there, she frantically got the party's attention. It turned out she hit a safe that was hidden in the wall. The demolition caused the safe to pop open, and in it was an ornate box. As Erika pulled the box out of the safe and began to open it, Max noticed, from her spot further down the wall, that the box was inscribed with "Will". Erika opened the box and found a small statute of a red herring, made out of gold. With the above facts in mind, answer the following: Question 12 (1 point) For this question only, if Max had been the finder instead of Erika, would Max have the most superior claim? 0 a) No, because she was there on behalf of her employer, so the claim belongs to the employer 0 b) Yes, she was the finder O c) No, because she was a trespasser. Q d) No, because her employer wasn't present Question 13 (1 point) True or false: the law will NOT presume a manifest intent to control access to a private home. Question 14 (1 point) Which of the following is true about found property? 0 a) The finder has the most superior claim 0 b) The true owner always has the most superior claim 0 c) The finder always has the second most superior claim, second only to the true owner 0 d) If more than a year has passed since the item was lost, the true owner has no claim Question 15 (7 points) Based on the original facts in the fact pattern above, rank the superiority of claim to the found the golden red herring. Rank only the following people: Joyce, Will, Karen, Max, Luukas, Erika. For each claimant, detail why you've given them the assigned position. Be sure to reference relevant course materials and/or case law as appropriate (you do not need to give case names, but the case should be identifiable from your description). Paragraph
