Because of its' legal definition, if a court decides to award liquidated damages it will: 1) also generally award compensatory and punitive damages as well. 2) also generally not make a determinati as to whether there has been a breach of the contract. 3) generally also award punitive damages but not compensatory damages. 4) generally award only the amount agreed upon in advance if there is a breach by one party.
