believe that this conduct is sufficient enough to rise to the level of a violation under the law. He was sexually harassing her by touching her in any manner without permissionconsent Considering that after this experience she could be uncomfortable in the workplace it would be best for her to report it to Human Resources so that they can keep an eye on the situation. The law should hold Terry accountable even if the event happened off of the premises because what he has done as now worked against a favorable working environment. He should be put on some sort of probation to ensure that there is an investigation made to see if he has been harassing anyone else in the workplace.
My opinion would not change if only I would increase his consequences in the workplace as well as lawfully. I would call for termination and for charges to be pressed against him. Christina would have an employment claim against him as he has now created a hostile work environment and created a quid pro quo situation by denying her deserved job advancement for denying his sexual advancements.
