Ben recently paid RM30,000 for a second-hand pickup-truck from Charlie for the purpose of transporting his fruits produced from his orchard to the fruit market. However, after paying the full sum for the pickup-truck to Charlie, Ben encountered several legal predicaments. Advice Ben accordingly based on the issues below with reference to relevant case laws and the Sales of Goods Act 1957:-
(a) The previous owner of the pickup-truck has not paid all parking tickets. Ben later found out that the local council had issued the pickup-truck with a compound of RM2,000. Furthermore, the previous owner had encrypted the GPS system with a password, and Ben is unable to use it; and
(b) Derek, the original owner of the car, alleged that the pickup-truck was stolen and wants it to be returned to him, but Charlie claims that he is the co-owner of the pickup-truck decided to sell the pickup truck.
