Berto bought from Samson 24 hectares of land which Samson had previously purchased from Ramon. At the time of the sale, the property was still covered by an OCT in the name of Ramon. Subsequently, the Register of Deeds filed a petition for cancellation of the OCT in the name of Ramon on the ground that the land in question had been previously registered in the name of Teri. Berto now filed opposition to the petition for cancellation furnishing Samson and Ramon by registered mail with copies of said opposition. The lower court declared void the title of Ramon and those derived therefrom like the titles of Samson and Berto. Berto sued Samson to enforce warranty against eviction contained in the deed of sale executed by Samson in favor of Berto. Will the suit prosper? Explain
