Big Brother Building Corp. invited tenders for excavating the foundation of Vancouver's tallest building, the Skyneedle. Holey Moley Excavation Inc. placed a bid of $10 million and received the contract. After beginning the project, Holey Moley realized that the job would cost $30 million to complete because it would require the excavation of rock instead of dirt. Holey Moley nevertheless carried on with the project in order to protect its reputation. However, after Holey Moley had dug half of the hole, Big Brother Building breached the contract by refusing to give Holey Moley access to the worksite. At that point, Big Brother Building paid half of the contract price to Holey Moley. Another excavation company completed the hole under a separate contract with Big Brother Building.Parties
