Bill, as landlord, and Sue, as tenant, sign a 1-year lease for an apartment in Bills apartment building with a monthly rent of $2,000 and a security deposit of 2 months rent. Sue also leases a storage unit in the basement for an extra $100/month and puts her $2,000 road bike and $1,000 skis in that storage unit. Sue needs this apartment to work remotely in every day. After Sue moves in, there is constant noise coming from the apartment next door. Sue cannot even participate in Zoom meetings at work because of all this noise. Sue complains to Bill and Bill says he will investigate it. The noise continues, Sue again complains to Bill and Bill again says he will investigate it. The noise continues, Sue rents another apartment, moves out of Bills apartment after 1 month and informs Bill she is leaving and wants her security deposit back. Bill informs Sue that she owes him 11 months rent and keeps the security deposit towards rent owed. Sue had forgotten to take her bike and skis when she left. She goes back to the storage unit, and they are gone. She asks Bill what happened, and Bill says they were stolen. Please comment on the legal claims of both parties.
