Bill Smith, a builder runs a construction company in Central Washington. He contracts with Pedro Rodriguez to build a home for $ 400,000. The home plan has 4 bedrooms, two full baths and is about 3000 square feet. They have a valid written contract. The construction is to begin in September 2021 and should be finished by December 2021 according to the contract and the builder. About half way through, Bill tells Pedro he needs an additional $50,000 to complete the project as building costs have skyrocketed. Also he requires him to agree on change orders (which allow Bill to charge additional money). Pedro verbally agrees to both but doesn't think he should have to pay this and doesn't want to be left with a house which is unfinished. Bill completes the house and Pedro refuses to pay the change orders or the additional $50k. Please discuss consideration, pre existing duty rules and whether or not Pedro has to pay the additional money and the change orders and why.
