Eightpatrons have become sick so far, and one has died.9:00 AMYou discover that an advertisement printed in the newspaper for your Special for Two, a five-course,fixed-price dinner with wine pairings, listed the price as $9.99 rather than $99.99. The phone has beenringing off the hook with Special for Two reservation requests.10:00 AMYour executive chef informed you that today would be his last day, as he has taken a position withGreen Man Bistro down the street. You reminded him he agreed to a two-year contract and that youshook hands on the deal. He just laughed, and then you remember you never put it in writing.11:00 AMOne of your female servers complained to you that a busboy has been making lewd and suggestivecomments to her when no one is around; it is making her uncomfortable, and she wants you to fire him.12:00 PMA patron wearing six-inch high heels slipped and fell on her way to the restroom, hitting her head on atable and injuring her back. She was taken away by ambulance, after making quite a scene.1:00 PMYou learned that your bookkeeper signed a contract committing the restaurant to a three-year wirelessservice contract with Verizon. She was not authorized to do so, and the restaurant is already committedto wireless service from AT&T.2:00 PMWhile performing the Heimlich maneuver on a patron whom she thought was choking, your overzealoushostess broke three of his ribs. You remember she was fired several months ago forperformance issues, but have no documentation in her file.4:00 PMYou found an anonymous note on your desk, alleging that several of your staff lack proper immigrationdocumentation and that the author of the note plans to notify federal authorities. You have I-9 formsand copies of social security cards on file for each worker, but on more careful inspection, they do looksuspicious.5:00 PMYour new server showed up her first day of work wearing a headscarf. You asked her to take it off whileworking, but she refused, claiming her religious beliefs require her to wear it in public, although she hadnot worn it during her interview. You fired her.6:00 PMYou received a visit from the owner of a competitor restaurant, Bistro 25, who demanded that youchange the name and logo of your restaurant because they are too similar to her restaurant. She claimsthat customers are getting confused between the two restaurants.7:00 PMIn reviewing the day's computer records, you came upon an email sent by your sous chef to hisgirlfriend, on his personal account, detailing his intention to begin going to Alcoholics Anonymousmeetings again. You confronted him, and when he admitted he is an alcoholic, you fired him.8:00 PMAnother server, whom you know has anger management issues, chased down a group of students whoskipped without paying their bill, and tackled and punched the one who had been talking trash allevening.9:00 PMThe police arrived and took away your dishwasher in handcuffs. When you objected, they told you hewas being arrested for possession and distribution of a controlled dangerous substance, and informedyou that he was dealing heroin out of the restaurant kitchen. They also searched the kitchen and foundother controlled substances.10:00 PMYour delivery boy caused a five-car pileup on I-75/I-85 when he was texting his girlfriend while driving tohis next delivery destination. All vehicles were severely damaged, and 12 people were taken to areahospitals for various serious injuries.11:00 PMYou heard from a patron that one of your regular customers, who left your bar earlier in the eveningafter having more than a few drinks, smashed his car into a tree. He is in the ICU and will probably neverwalk again.Exhausted, you call your lawyer and give her a brief synopsis of the day's events. She wants to meet with youtomorrow afternoon. She has asked that you and your management team do the following to prepare for themeeting:

1.Identifythe 5 events that you believe pose the greatest risk ofpotential harmto the restaurant. If you havetime, rank them from most important to least important risk to the restaurant.2.For each event, describe thearea of lawthat you think is most applicable. (Think of it this way: If you weregoing to hire a lawyer for just this problem, what would that lawyer specialize in?)3.Describewhat, if anything, you think you should do inresponseto each of these 5 events, and explain why.What could you have done, if anything, to have prevented these incidents?Working in pairs, make your choices and discuss your analysis.
