Bob owns a sweater-making business. He has recently introduced a newmatching clothing line for preschool children and their dolls. Theclothing line is unique as the sweaters have charms on them that are suitable for avariety of occasions. For example, there are Valentine's Day sweaters with varioushearts attached to the pockets. Included in this newest production are matching clothesfor dolls that have the exact small charms and buttons that the toddler line hason them. Kendra, a 2-year old, was given a sweater for her and her doll for her birthday.One of the charms, a birthday cake, fell off of one of the pockets of Kendra's doll'ssweater, as the stitching did not secure the charm in place. Kendra picked it up and putit in her mouth to show her doll that the cake was delicious. Unfortunately, she began toswallow the charm. Luckily, her mother was walking by Kendra's room where she wasplaying and saw the youngster choking. The mother rushed Kendra to the emergency room. Though Kendra (and the doll) are now fine, the mother has a sizable emergency room bill that she wants Bob to pay. If the mother sues Bob and his company, will she likely win her tort claim? Why or why not?
