Bobby Unser (three-time Indy winner) and a friend went snowmobiling near Unser's ranch in northern New Mexico. While on their short ride, a ground blizzard resulted in near-zero visibility. The two men got lost trying to find their way back to the truck. One machine crashed when they went into a ravine, and Mr. Unser's snowmobile eventually stopped working. The two lost men spent the night in a snow cave. The next day, they found a barn and called for help from a phone in that barn. They were treated for frostbite, dehydration, and exhaustion. The snowmobiles were found in a National Forest area. Mr. Unser was charged with unlawful possession and operation of a motor vehicle within a National Forest Wilderness Area. Mr. Unser says he did not intend to enter the area but was lost in the snowstorm. Can he be convicted of a crime? [U.S. v Unser, 165 F.3d 755 (10th Cir. 1999)]
