Bottoms and Tops, International,Inc. shipped a package containing jewelry by United Parcel Service (UPS) to its salesman Ed Dwek at the Marco Polo Hotel in Miami Beach, Florida. The package was delivered to the hotel and signed for by the bell captain, who placed it in the package room and alerted Mr. Dwek by illuminating the call light in his room to contact the front desk. The bell captain released the package to an individualbearing a key to Mr. Dwek's room.Mr. Dwek did not receive the package and Bottoms and Tops sued UPS for failure to deliver the package to the consignee, Mr. Dwek.
