Brad and Kalsie are co-workers at Big Jims Boot Company. They hit it off and start dating. After a year or so, Kalsie ends the relationship. Shortly thereafter, Brad is promoted to a manger and is now Kalsies boss. Brad now begins to see Kalsie in a different light as an employee: She is almost always late for work, she takes more than the time allotted for her breaks and her lunch, and she does less work than the other employees. Brad doesnt say anything at first but he could lose his job because of her incompetence. So finally he calls her in his office and discusses the problems he is having with her. Kalsie becomes all defensive and storms out. She continues to come in late, take too long on breaks and lunch, and still is not doing the same amount of work as her co-workers. Brad has no choice but to write her up; which he does. This infuriates Kalsie! She begins to come in even later than normal for work, she takes even longer on her breaks and lunch, and does even less work than she was doing before. Brad fires her. Kalsie goes to see an attorney about suing Brad for sexual harassment. She claims that he harassed and fired her because she broke up with him.

You are the attorney representing Brad. You receive a settlement offer from Kalsies attorney which states that if you agree to pay her 1 year wages of $25,000 she will not file the sexual harassment lawsuit against Brad. Brad says that he is innocent. That her actions had nothing to do with the fact that they dated. That she was a bad employee and he can prove that she was late, came back late on breaks and lunch, and that she did less work than her co-workers.

state why you would or would not advise Brad to take the settlement. Be sure to list the elements of sexual harassment when making your legal arguments.
