Brandon and Lulu also orally agree that Lulu will buy Brandon's car for a price of $3,000.Lulu gives Brandon a $500 deposit for the car and they agree that she will pay the remainder of

the purchase price of the car on March 15.On March 8, Brandon decides that he does not want to go through with the sale of either the house or the car.Lulu sues Brandon for breach of contract.Brandon asserts the statute of frauds as a defense. Lulu defends that she already made partial payment on both the house and the car, and also that the deposit check for the house is a valid writing to satisfy the statute of frauds.
