Brian ran a football club which had a playing field and clubhouse, with registered freehold title. Inside the clubhouse was a kitchen, drinks bar, large meeting hall, and a small storeroom full of footballs, training and other equipment owned by the club. Due to COVID-19, the football team stopped playing and training there in March 2020 due to COVID-19.

Brian's girlfriend June, had a 19-year old son, Rocky, who had nowhere to practise with his band, which consisted of Rocky (the singer) and three other schoolmates (who played electric guitar, keyboard and drums).June asked Brian whether the band could use the empty clubhouse to practise, and Brian agreed. Brian typed up an agreement between himself and Rocky, which said 'Rocky's band may occupy the clubhouse rooms until COVID-19 ends, provided Rocky pays $10 a week towards electricity and water.' Rocky and Brian signed and dated the agreement 1 April 2020, and on that date Brian handed Rocky the key to the clubhouse door, saying, 'I'm keeping a spare for emergencies and in case I need to get anything out of the storeroom'. The band practised there every day and night from then on , and Rocky paid the $10 weekly by direct debit from his bank account.

On the last day of June, Brian split up with June, a Port Adelaide fan, after a big argument in which she accused him of being a Crows supporter, which he denied and he said,' right well I want your son out of that clubhouse then'. The next day, Brian executed a two-year lease of the clubhouse to a Table Tennis club run by his friend Raj, and Raj registered the lease. Brian gave Raj another key to the clubhouse door. The next day, the table tennis club turned up with their equipment and were met by Rocky and the band, who showed them the week's COVID-19 statistics for Australia and refused to let them enter. Raj went back to Brian to complain, and said that the lease promised the table tennis club vacant possession.

Advise Brian about the legal position regarding Rocky and the band's occupation of the clubhouse.
