BUS 204 - ON1 Assignment Mark - 7% Adam was elected as a director of a society called the Abbotsford Homeless Support Association. The Society operates a homeless shelter that houses 30 men and has a cafeteria style kitchen for providing food. The Society rents the homeless shelter which was a former motel from Ben, who is also a director of the Society. Ben is paid $120,000.00 per year in rent. The Society's overall budget pays the salaries of five employees - being a manager, two counsellor/support workers, one cook and a night watchman. Another $130,000.00 is paid for food, utilities and all other associated costs. The Society receives $250,000.00 of its annual $500,000.00 budget from the provincial government and $250,000.00 per year from donors, the most significant of which is Charles, who gives $50,000.00 annually and is also a director of the Society. Although the rule is that no man could stay in the shelter for more than 30 days, an exception was made for David, who has had his own room in the shelter for three years. Everyone knows that if he left he would be back on the streets. He is the son of Charles and one of the reasons for Charles' commitment to the cause of homelessness. Adam, during his first year as a director, discovered that the Board exercised very little financial oversight and it was discovered that a contract bookkeeper, Eunice, had stolen $40,000.00 of the Society's funds, which has only been discovered now. The Chair of the Board, Frank, is adamant that the matter should not be disclosed to the public, since it would affect donations. As a result, the police were not called. Also during his first year Adam discovered that Gordon, one of the two counsellors, has a criminal record for previous sexual criminal offences and that he had been hired without checking. Adam has been hearing that there are rumours about Gordon's conduct with some underage homeless in the area. When the rumours were raised at the next Board meeting, Adam discovered that Gordon was Frank's nephew and Frank strongly discounted the issues as "rumours" and refused to allow the matter to be put on the agenda for discussion, on the basis of privacy concerns for the affected employee, Gordon. Adam feels that Gordon should be terminated. Adam is frustrated, but strongly believes in the Society and it's program of providing shelter for so many of the homeless. Adam is financially comfortable himself and does not want to be personally sued for any failure on his part as a director. Questions: 1. What possible concerns do you see for Adam to consider? Detailing each one carefully, determine which ones are a risk to the Society. 2. What possible alternatives does Adam have to deal with the concerns on behalf of the Society? 3. What concerns could possibly affect Adam personally, and what would be the best course of action for him? 4. What policies would you suggest to the Society to deal with the concerns that you have identified in the future? Please draft out the policies that you deem appropriate. 5. If the Board decided to terminate Gordon, what concerns would they need to address from an employment law perspective
