Because XYZ PLC was not able to pay the 300,000.00, ABC PLC opened an execution file in order to get the money in accordance with the decision Since XYZ PLC was not still willing to pay the money, ABC attached excavator which belongs to XYZ PLC, After the excavator was attached, the general manager of XYZ PLC applied to the court handling the execution that the property belongs to him but not to the PLC so the property should be released from attachment, The court accordingly released the excavator. After the excavator was released, the manager of XYZ PLC sued ABC PLC claiming Birr 264,000.00. The reason the amount of money claimed was that during the period of attachment, the company has lost Birr 264,000.00. If the excavator was not attached, the excavator would have generated Birr 264,000.00 The evidence submitted by the manager in order to prove the case was the title deed(libere) and a contract concluded between XYZ PLC and DEF PLC. ABC PLC in its statement of defense argued that XYZ PLC is a person so the action must be presented in its own name but not in the name of the manager. The evidences submitted by the manager i.e., the title deed(libere) and the contract shows that the excavator belongs not to the manager but to XYZ PLC. So since these two evidences show the fact that the excavator belongs to XYZ PLC but not to the manager, the action must be presented by XYZ PLC but not by the manager.
