3) Tadlock was a tenant on Lests farm. Tadlock ordered a new irrigation pump for the farm from Killinger. Tadlock told Killinger that he was Lests tenant and that he had authority to purchase a new pump on Lests behalf. Killinger then installed the new pump and billed Lest for $5,048. Lest denied liability on the claim. In the suit by Killinger vs. Lest for payment of this claim, Killinger defends his action on the ground that Lest is liable because Tadlock had apparent authority.
