LAW 0115 CA2 - INDIVIDUAL ASSIGNMENT JAN - MAR 2022 On 1 October 2021, Sam Soh entered into a contract with Phua Choo Kung Pte Ltd 1 (PCK) to renovate his dog obedience school, The Woof Woof Retreat & School. The cost of the the renovations was $40,000. Under the terms of the contract, a 10% deposit of $4,000 was paid by Sam Soh on the signing of the contract. Another $4,0000 was payable upon the design being approved by Sam Soh. The balance of $32,000 was to be paid on the completion of the renovation works. The renovation works included, amongst other works, building 20 crate spaces for dogs to sleep and a swimming pool. The contract also provided that PCK was to complete the renovation works and hand over the school to Sam Soh not later than 30 December 2021. The design was approved by Sam Soh on 10 October 2021. PCK proceeded with the renovation which was completed on 28 December 2021. When Sam Soh inspected the premises on 28 December 2021, he was not pleased with the quality of workmanship for the built-in crates. He demanded that PCK rectify the "defective crates. PCK disagreed and declined to do any further work. On 3 January 2022, Sam Soh called another contractor, Fixit Pte Ltd to inspect the crates. Fixit Pte Ltd quoted $2,000 to rectify the crates to Sam Soh's satisfaction. On 4 January, PCK contacted Sam Soh and demanded payment of the balance amount of $32,000. Sam Soh refused to pay the balance and insisted that PCK rectify the built-in crates by 10 January. PCK refused and had not been paid by Sam Soh. PCK sought your advice on the following: (a) Define discharge of a contract and briefly explain FOUR (4) ways a contract may be discharged. (b) Discuss the LEGAL PRINCIPLES concerning the above case study, APPLY the legal principles, and CONCLUDE on whether PCK could treat the contract with Sam Soh as discharged and recover the balance $32,000.
