Arlene Dickson was a waitress in a restaurant owned by the Howard Johnson Company. On May 23, Mary Rogers, manager of the restaurant, called a meeting of all waitresses at which she informed them there was some stealing going on. Rogers also stated that the identity of the party or parties responsible was not known and that she would begin firing all waitresses in alphabetical order until the guilty party or parties were detected. She then fired Arlene Dickson, who allegedly became greatly upset, began to cry, sustained mental anguish, and loss of wages and earnings.
