QUESTION 2 Eman decided to start an online business and intended to buy a new poweril computer. He visited VC Planet and described his requirements to one of the shop assistants, who recommended a new Macrofirm X. The shop assistant further recommended a particular software package, Macrofirm XXX which VC Planet would install immediately. Eman agreed to the installation and bought the computer for the price of RM4|300At the cash desk, Eman was given a form to sign, which he did, without reading the contents. The software package was installed by Jack, an employee of VC Planet and after the payment was made, Eman took his new computer home. After three weeks of perfect service from the computer, it crashed and failed to start again, despite repeated attempts. He went to VC Planet and lodged the complaint but the owner of VC Planet told Eman that the Macrorm XXX software which they had installed into the computer has rendered the computer irreparable. When Eman complained, PC Planet showed the document which he signed at the time of the purchase, in particular, the following clause: 0 2.1. VC Planet shall accept no liability for the quality of their computers or software, or for any other losses, howsoever arising. With reference to the Sale of Goods Act 195'? and relevant case law, advise Eman. State also the effect of the above contract from the Islamic perspective of al-Bay. (20 MARKS)
