Question Oliver owns a business that sells 'esh fruit. One day, Jimmy and his sister visit Oliver's store and notice that Oliver is advertising Granny Smith apples for sale for $1.00 each. Jimmy says to Oliver that he will take 5 apples. As Oliver is placing the apples into a plastic bag, he tells Jimmy that he can have 10 apples for $9.00 if he wishes. As Jimmy gives thought to this, Oliver moves away to serve another customer. Jimmy then realizes he only has $5.00 and so asks his sister for the extra $4.00 so that he can buy the 10 apples. Unfortunately, J immy's sister only has $3.00. When Oliver returns, Jimmy tells Oliver that that he will take 10 apples for $8.00. Oliver then tells Jimmy that the price of the apples can't be further reduced and that if he wants 10 apples, it will cost $9.00. Jimmy and his sister then leave the store. Jimmy returns a week later and places 10 apples into a bag and hands Oliver $9.00. Oliver tells Jimmy that the apples are $1.00 each and that 10 apples costs $10.00 Jimmy claims that he has an agreement with Oliver. Using the IRAC legal technique explained and demonstrated in class, advise Jimmy on whether or not he has an agreement with Oliver
