Kim just turned nineteen and was celebrating her birthday. Kim told Mark that she liked his purple car. Mark, trying to impress Kim, offered to sell it to her for $400. She accepted the offer and agreed to pick it up the following afternoon. The next afternoon, when Kim went to Mark's house with the $400 in cash, Mark stated that he had been really drunk last night when he agreed to sell her the car. Kim told Mark that a deal is a deal. Mark reluctantly agreed. He accepted the $400 and gave her the keys and title to his car. One week later, Mark decides that he wants his car back. Kim says "No", so Mark files a lawsuit to rescind the contract.
