Sam Madison was incarcerated in a New Mexico state prison when two NM state police officers began questioning Madison about his connection to a handgun that had been used to shoot and kill another NM state police officer. The officers did not advise Madison of his Miranda rights before questioning him. Instead, the officers told Madison that "nobody is going to give you charges for any of this." Madison told the officers that he had sold the gun to another man, Ben Shelfly, about a year ago. Madison also told the officers that, before he sold the gun, he had used it to kill five people in New York state when he used to live there. Madison also provided additional information about these killings, including the locations of the bodies. Subsequent police investigation confirmed that all of Madison's statements were true.

Based on the police investigation and the incriminating statements made by Madison himself, Madison was indicted on various criminal charges: one count of criminal possession of a deadly weapon by a convicted felon, and five counts of reckless manslaughter.
