Calvin Harris ordered two model XRAY speakers from Musicville Wholesale Electronics, Inc. on November 1, 2019. He was hoping to use this speakers during his New Year's Eve bash in Las Vegas. Musicville shipped the speakers via UPS, C.O.D. (collect on delivery) although Calvin had not requested or agreed to a COD shipment of the speakers. When the speakers were delivered, Calvin refused to accept them because he would be able to inspect them before payment was issued. Musicville claimed that it had shipped confirming goods and that Calvin had breached their contract.
