Camilo owns and operates a seafood restaurant. He has a large cool room where he stores the restaurant's seafood. Because he stores a large quantity of expensive seafood, he engages Brendan, a refrigeration repairman, to perform ongoing maintenance on the cool room refrigerator on a weekly basis to ensure it never breaks down.

Brendan fails to perform the maintenance on the cool room refrigerator for three weeks in a row and this causes it to break down. Camilo loses $5,000 worth of seafood that goes bad. As well as the seafood, Camilo also stores a rare Picasso painting worth millions of dollars in the cool room because the temperature is just right to preserve the artwork. The cool room refrigerator breaks down causes the painting to deteriorate slightly. An art expert estimates the damage to the painting to be around $400,000.
