Can a teacher look at a message that pops up on a student's cell phone? If a teacher were to confiscate a student's cell phone because the student had the phone out in class. This teacher puts the phone on the corner of her desk and continues to teach her lesson. At the end of the lesson the students are to work quietly on an assignment. While the students are working the teacher sits at her desk to do other work. While everyone is working the teacher hears a vibration and sees the phone of the desk light up. She pick up the phone and reads the message. The message is a text message that is sexual in nature. My question from this scenario is did the teacher violate the student's Fourth Amendment right against unreasonable searches and seizures by looking at the test message when it popped up on the screen? What do you think?
