Here are the facts: (assume the facts to be true.)

Two blocks into Marcia's trip to the caf, the grogginess sets in and she blacks out.Marcia crosses the center line and strikes a car driven by Mike and Carol.Greg, who decided to drive to the caf, comes upon the grisly accident.But, he does not stop or offer any aid.Instead, he laid on his horn and flipped the middle finger as he passed by.Mike died instantly.The detective in the case determines it likely that he would have survived had he been wearing his seatbelt.Carol survives the crash and is taken to the hospital. Marcia survives. Marcia's blood screens reveal a .00 blood alcohol content, but a high amount of GHB (gamma-hydroxybutyric acid).GHB is a drug commonly used in date rapes.Carol endures 8 hours of surgery for internal injuries and survived.Unfortunately, one of the emergency room doctors left a rubber glove in her body cavity during the surgery.Several days after surgery, the glove becomes twisted around Carol's colon and she dies.

Detective Alice Nelson is assigned to the case.She questions Greg, Sam, Marcia, and Bob, who all agree to meet her at the police station.Below are the replies to her question, "do you have anything to say:"

Harassment is considered as unwanted verbal or physical behavior that intends in offending or humiliating another person. Harassment is established in numerous forms that could be physical or verbal where this behavior is intentional. An individual guilty of harassment may face both civil and criminal liability (Hemel & Lund, 2018).

Greg and Sam will face criminal harassment charges which are based on the following elements:

1. Both acted intentionally

Greg had physically abused Peter by slapping his drink out of his hand and verbally harassed Marcia and Peter to leave Double B for good of face his wrath.

2. The actions were repetitive

Sam physically abused Peter by grabbing him in a headlock, dragging him to the backroom, and eventually tossing him out of the front door.

3. The actions cause a threat to Peter and Marcia leading them to leave the bar.

Civil Harassment is the harassment that resulted in discrimination. There is workplace discrimination where under Title VII of the Civil Rights Act of 1964 the employees are protected against discrimination at the workplace such as discrimination based on sexual orientation (Feldman, 2019). Greg will face sexual harassment on Sam based on his sexual orientation.

Sexual Assault: Attempted Crime (PC 664) is the unsuccessful attempt for any criminal act that can be punished.

Greg will be charged with attempted rape after accomplice with Sam after intoxicating the Marcia drink with little "fun". Both will be charge with attempted rape as the attempt of having sexual intercourse with Marcia without her consent but no sexual penetration occurs.

Tort Law: A tort is an act or an omission that gave rise to the injury or harm to another leading to the civil wrong which imposes liability. The imposed liability will be on parties responsible for the harm as an act of deterring others from committing the harm (Engstrom, 2018). The hospital and the doctors will face the medical malpractice claim on Carol dying after negligence that involved leaving a glove twisted around Carol's colon. It was an inappropriate medical standard of care as Carol succumbed as the result of leaving a rubber glove in her body.
