Can you assign rights at law under a business sale contract (for services, not land) or would it be considered not aboslute and conditional under s 199 of the Property Law Act? Under the facts, the assignor is attempting to novate the contract to transfer the business, but has failed, wondering if the rights under the contract could still be assigned or if they cannot becuase the sale of business would mean the assignment is not abolute and/or conditional.
