case:
Plaintiff, Sukhjeet Kailey and Damanjit Saini wanted to buy new house. They gave the offer for a house and deposited minimum non-refundable $25000 in cash. After depositing non- refundable money, they went to bank to get mortgage but Bank rejected them and did not give mortgage. So, Damanjit Saini and Sukhjeet Kailey (Plaintiff) approached their family friend Gurinder and Sandeep Kaur (defender) for help as they did not want to lose that non-refundable money.Sandeep and Gurinder agreed to offer help and got mortgage on her name and the house would be on her name. But Sukhjeet and Damanjit Saini will be making all the payments. This deal was done, so that Sukhjeet and Damanjit Saini has more time to get mortgage approved. Unfortunately, they were unable to get their mortgage approved and stopped paying the payments for the house. When Gurinder and Sandeep knew about this they asked Sukhjeet and Damanjit Saini about payments, they had no proper response.
Finally, Gurinder and Sandeep decided to sell the property. When they sold the property Sukhjeet and Damanjit Saini asked them to pay back the $25000 that they invested in house. Defendant party did not agree with that as they said Sukhjeet and Damanjeet broke their trust as they were trying to help them out. So Sukhjeet and Damanjit Saini sued Sandeep and Gurinder.
After listening everything, judge offered both parties an opportunity to do settlement and explained them if both parties go on trial none of them would be benefitted from it. Firstly, none of them was agreed. After that Judge asked both parties number of questions and then Finally, both parties agreed to have chat and asked Judge for 10 min. I was trying to listen them carefully as Plaintiff and defended both were arguing about how both parties go mentally affected. Plaintiffs asked for whole $25000 dollars whereas defended was only offering $15000 with argument stating that they broke their trust wasted their time. Eventually, both parties agreed on the settlement that, defended will have to pay $15000 to plaintiff within two weeks and case will not go on Trial. At end, settlement paper was printed stating all conditions and was signed by both parties as well as judge and court were dismissed.
