Caplan Lane enters Second National Bank of Scotia (SNBS) and speaks with the President of the Bank about opening a series of bank accounts.Caplan indicates that he would like to open 37 individual accounts with debit cards for each of the neighborhood kids in order to teach them about savings and financial accountability.Caplan provides SNBS a written list of all the kids in the neighborhood and then orally tells the SNBS that he would be willing to cover any over drafts if the accounts are over drawn and the kids themselves do not make good on the over drafts.Caplan then provides the bank with $370 cash to put $10 in each account and then instructs the bank where to send the bankcards.Approximately two months after the delivery of the cards, 30 of the 37 accounts are now overdrawn in the total amount of $523.What legal issues do you see with regards to each of the parties.
