You want to improve your company's hiring process, by having individuals applying for a job as a server come into the restaurant and wait tables for a few hours so you can assess their performance. Would you need to pay the applicant, or could you consider the exercise to be part of the hiring process? Explain your thoughts.

Discuss the possible reasons for the exemption(s) and whether those reasons make sense in today's workplace. Should the exemption(s) be removed? What implications would that have for the workplace?

Sasha was a bank employee with 21 years' service whose IT role entitled her to virtually unlimited access to confidential documents. One day, Sasha decided to access sensitive information concerning priority parking, without permission, to satisfy her curiosity about where she was on the list for the most prized parking spots. As soon as the employer found out about this action, it dismissed Sasha for just cause. Sasha sued the employer for wrongful dismissal.

What arguments do you think Sasha would use to support her wrongful dismissal claim? Did the employer have just cause in your view?

Jennifer, age 16, and her brother George, age 14, both worked for Value Veggies, a vegetable grower. They were of the Christian Mennonite faith, and Jennifer advised her employer several weeks in advance that she would need to take a particular Thursday off to celebrate a Mennonite holiday. Value Veggies replied that she could not have a Thursday off because, as per its attendance policy, employees must be available on Thursdays since that was the day when they had to ship products to grocery stores for the weekend shopping rush.

When Jennifer failed to show up for her shift that day, the owners of Value Veggies contacted her mother and said Jennifer and George (who was not scheduled to work that Thursday) were fired.

Jennifer and George filed human rights applications alleging discrimination. The employer responded that the applicants knew of the policy and knew they could be terminated if they failed to comply with it.

You are leading the tribunal that will assess this situation. On what basis will they make their claim alleging discrimination? Will Jennifer's claim be successful? Will George's claim be successful? Explain your decision in detail. Explain any assumptions you made.

You are the HR Manager a cereal factory.

Two years ago, one of the machine operators at the cereal factory, David, confided in a colleague that he had had a brief affair with his supervisor's ex-wife. Several co-workers have since picking on him by making negative comments.

Despite numerous complaints to his supervisor, Jason (yes - the same supervisor whose ex-wife he had the affair with!), who witnessed some of these insults, nothing was done.

Frustrated with the lack of response, David has come to you to file a complaint. You have a good relationship with Jason, and informally mentioned the complaint to him, who insisted that it was not a serious problem.

Please detail how you will respond. Include your assessment of David's complaint, steps to be taken in an investigation if any, and reference to any applicable legislation, policies, procedures etc. if any.
