Carlos inspected Teds jet-ski with a view to purchase. Ted told him the engine was in top condition and he had maintained the servicing of the craft. Carlos did not know much about engines and just went along with this statement. They signed a contract which was silent on the state of the engine. The engine seized up on the first day out and a mechanic told Carlos it was in poor condition and appeared never to have been serviced.
