Carlos inspected Ted$$s jet$-$ski with a view to purchase. Ted told him the engine was in $$top condition$$ and he had maintained the servicing of the craft. Carlos did not know much about engines and just went along with this statement. They signed a contract which was silent on the state of the engine. The engine seized up on the first day out and a mechanic told Carlos it was in poor condition and appeared never to have been serviced.
