FACTS:

The facts describe the events that led to the controversy in question. All that is required is a brief statement of the acts, physical events or other matters that caused the parties to seek relief from the judicial system. (Should be no more than six sentences.)

When parties come to court, they are seeking to resolve a particular issue. The issue is the reason why the parties are in court. It is a onesentence statement followed by a question mark. The issue is what the court must answer in granting or denying relief. Attorneys can labor for hours over the exact wording of the issue, so that they properly frame the issue for the court. Good Example: "Was the contract supported by adequate consideration?" Bad Example: "Who is right?"

In reaching a decision, the court must apply the law. Discuss the cases or principles the court is applying to the case.

ANALYSIS:

Think of this section as the application of the facts to the law in deciding the case. The analysis will include the court's rationale in deciding the case.

CONCLUSION:

Who won the case? What does the decision mean for each party?
