Case Facts: Part 1-Male employee Fred was one of 10 male firemen who lived in a fire station when they were on-shift-Female civilian Trixie would visit the station, with the fire-captain's permission, approximately once per week. -During Trixie's visits, she would walk into all areas of the station, including the station's kitchen where firemen would be preparing meals for themselves and their fellow firefighters. -Trixie would occasionally flirt with some of the firemen.Case Facts: Part 2-On December 31, 20XX, Trixie visited the fire station when most of the firemen were absent.-Fred was present making a meal for himself and the other station employees. The food was purchased by the employees for their own use. -While he was preparing this food, Trixie tried to talk to Fred. -Fred gave short and abrupt answers to each of Trixie's questions. -Trixie was undeterred and kept trying to talk to Fred. Case Facts: Part 3-Trixie eventually approached Fred as she talked to him and stood behind him as he prepared the food.-Trixie then leaned forward and attempted to reach around Fred and grab some of the food Fred was preparing. -Trixie described this action as "playful." Fred was annoyed at this action and attempted to stop Trixie's action by hitting her moving hand. -Fred missed the hand and hit Trixie's cheek. Case Facts: Part 4-Fred indicates this was an accident, while Trixie indicates that Fred hit her cheek on purpose. -The impact from the blow to Trixie's cheek did not move Trixie from the position she occupied at the time she was hit, but did cause her cheek to redden. -Trixie began to cry and after a few minutes, left the station and called law enforcement officers to come and arrest Fred.
