Case: Henry was invited by Ross to dine at Bulaluhan Restaurant as a sign of gratitude for all the favor that the latter gave to the former. Ross believed that the said restaurant is the best place to dine since it was referred to him by his wife. They ordered bulalo, which is the specialty of the restaurant. Unfortunately, the waiter accidentally poured the newly cooked bulalo over the head of Ross, which caused him permanent baldness. Can the restaurant be held liable for the accident that occurred? Answer: Based on the given scenario one of the employees/waiters of the said restaurant accidentally poured the newly cooked bulalo over the head of Ross, which caused him permanent baldness. From our standpoint/perspective, the restaurant is liable for the accident that occurred the particular reason for the circumstances is that when restaurant employees make a mistake or fail to do what a reasonable person would do, the restaurant is negligent. Employees owe a duty to their employers and company to carry out their work with reasonable care and quality service so as to avoid accident and injury however when an employee negligence causes a customer's injury or illness, the restaurant becomes liable, or responsible, for the customer's damages. Similar to Ross's scenario, the said restaurant must be accountable for the insurance that covers medical bills and damages for Ross injuries on the premises because whoever by act or omission causes damage to another, there being fault or negligence is obliged to pay for the damage done. Also, according to Article 2180 of the NCC. Vicarious Liability. The obligation imposed by Article 2176 is demandable not only for one's own acts or omissions but also for those of persons for whom one is responsible. It states that the owners and managers of an establishment or enterprise are likewise responsible for damages caused by their employees in the service of the branches in which the latter are employed or on the occasion of their functions. Taking the right steps during and after an accident will help minimize the restaurant liability as a business owner
