alized glass for industrial use. The company has employees and a management staff of
seven including Tildens position. SenGlas has been in business for over years and has a
wellestablished human resource department.
On Friday morning, the companys shipping coordinator, Mary Booth, came into Tildens
office quite agitated and said she was fed up She wanted to file a formal complaint against one
of her coworkers, Bob Simonsky, a forklift driver, for his harassing behavior toward her.
Simonsky had been working with SenGlas for twenty years. Booth joined the company five years
ago and had held administrative positions before getting promoted to her present position in the
warehouse. Both of them worked on the second shift in the plant. She told Tilden that Simonsky
was continuing to treat her in a very nasty manner because he didnt want to work with a
woman. Booth said she had tried for a long time to ignore his actions toward her. However, she
said his behavior toward her was getting out of hand and that she no longer looked forward to
coming to work and was suffering from headaches every day. She claimed Simonskys behavior
created a hostile work environment for her and she could no longer bear it
In her written complaint, Booth specifically alleged the following:
That Simonsky had made false accusations about her behavior toward another employee,
Ginny Miller. Simonsky had told Miller that Booth was threatening to hurt her physically;
That Simonsky on more than one occasion had revved his forklift engine and drove
straight toward her while laughing when she tried to give him orders about a delivery;
That he had slammed the metal forks of his forklift on the ground in an intimidating
manner; That he continuously refused to take any directions from her about which shipping
trucks to load or unload;
That twice he had thrown a cigarette butt at her;
That he would regularly tear up instructional notes she left for him;
That Simonsky had told another worker, Henry Mueller, that Booth had f with
the wrong person and that when he got through with her not even Jesus Christ himself
would be able to save her.
That two other fork lift drivers, John Griffin and Henry Jackson, had overheard
Simonsky say that women did not belong in the warehouse area and that he preferred
working with men.
That when she first started in the position as shipping coordinator that Simonsky had
told her, I hate that maggot. I should have killed her when I had the chance,
referring to Sally Jenkins who held the shipping coordinator position before her.
Although Tilden had only joined the company six months ago, he had heard about
Simonskys bad temperament from many people in the company. On one occasion Simonsky
had even been rude to him. Tilden asked Booth if she had reported the incidents to her
supervisor. She indicated she had and her supervisor had told her he would speak to Simonsky.
Tilden decided he had better review SenGlas sexual harassment policy see Exhibit before
investigating Booths allegations.
