Case Study:

Micah and Brian were friends in high school, but after graduation, their paths diverged dramatically. Micah studied business, got a good job, and even managed to purchase his own nightclub after several years. Brian started doing drugs, dropped out of university, and then held a series of menial jobs in between serving time in jail for assault and theft. Brian had a problem with anger management and could often over-react to the smallest things.Brian recently approached Micah seeking a favour: he needed a job. Brian had heard that Micah washiring bouncers for his nightclub and Brian hoped that Micah would consider hiring him for the role. Brian assured Micah that he was "clean": he no longer took drugs or abused alcohol. On the one hand, Micah wants to help his old friend. Brian was a good guy who had made some bad decisions. Maybe he just needs a second chance to get things right. But on the other hand, Micah knows that being a bouncer requires self-control and the ability to use enough force, but not too much. Bouncers also have to be able to deal with obnoxious drunk patrons and not over-react to situations.

1. Micah is evaluating the legal risk posed by hiring Brian. What tort(s) will raise the most concern for Micah if he hires Brian? In other words, what tort(s) is/are Brian most likely to commit as a bouncer? Explain your answer
