Andrew was a teacher at Maryfield High School. He often arrived late for classes and
had received several reprimands from the Principal over the years. The Principal was
concerned as the students were often unsupervised. Finally in May the Principal
decided that Andrew had to be disciplined and suspended him for two weeks withou
pay.
Andrew felt that the Principal was being unfair as he was not the only teacher who ofter
arrived late for classes and the other teachers were never disciplined. He felt that the
Principal had a personal grudge against him as he did not like the amount of attention h
was paying to his daughter Susie. Andrew felt that the Principal had no case for his
action and decided to appeal to the Ministry of Education.
To justify his appeal, he made a request under the Access to Information ATI Act to s
the attendance registers documenting the attendance for all members of staff over the
five years. The Principal said that apart from the current one, he could not find the
others and that they must have been destroyed. Andrew then asked to see the letters of
reprimand regarding tardiness sent to the other teachers during the same fiveyear
period to determine if he was being fairly treated. The Principal refused stating that
personal files were confidential.
Andrew appealed this disciplinary action and the denial of his ATI request to the Minis
of Education. He stated that he had been unfairly treated since there was no documentar
proof to substantiate his suspension in comparison with the treatment of other teachers
who were often late for school.
